Agreement to Terms
By accessing and using the Gracefulmerchant website (gracefulmerchant.world), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use our website or services.
Services Description
Gracefulmerchant provides handmade cards and printed materials including but not limited to:
- Custom greeting cards for various occasions
- Wedding invitations and stationery suites
- Printed materials such as notecards and letterheads
- Custom design services for paper products
Orders and Pricing
All prices are listed in New Zealand Dollars (NZD) and are subject to change without notice. We reserve the right to:
- Refuse or cancel any order at our discretion
- Limit order quantities
- Verify information before processing orders
- Correct pricing errors when identified
Custom Orders
For custom card designs and printed materials:
- A deposit may be required before design work begins
- Design changes after approval may incur additional fees
- Final approval is required before printing commences
- Custom orders are non-refundable once production begins
Intellectual Property
All content on gracefulmerchant.world, including designs, images, text, and graphics, is the property of Gracefulmerchant and is protected by copyright law. You may not reproduce, distribute, or use our content without written permission.
Custom designs created for clients remain the intellectual property of Gracefulmerchant unless otherwise agreed in writing.
User Responsibilities
When using our website and services, you agree to:
- Provide accurate and complete information
- Not use our services for unlawful purposes
- Not submit content that infringes on third-party rights
- Not attempt to interfere with website functionality
Consumer Guarantees Act 1993
Nothing in these Terms of Use excludes or limits your rights under the Consumer Guarantees Act 1993 (CGA). Where you acquire goods or services from us as a "consumer" (for personal, domestic, or household use), the guarantees under the CGA apply. We cannot contract out of the CGA in respect of consumer transactions. Where goods or services are supplied for business purposes, the CGA may not apply or may be modified by agreement in writing.
Limitation of Liability
To the extent permitted by law (and subject to your rights under the Consumer Guarantees Act 1993 where applicable), Gracefulmerchant provides products and services "as is" and makes no warranties regarding quality, fitness for a particular purpose, or accuracy of information. Our liability is limited to the purchase price of the products ordered, except where the CGA or other mandatory law provides otherwise.
Fair Trading
We comply with the Fair Trading Act 1986 (New Zealand). We do not engage in misleading or deceptive conduct in connection with our goods or services.
Governing Law
These terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
Changes to Terms
We may update these Terms of Use from time to time. Changes become effective when posted on this page. Your continued use of our website constitutes acceptance of updated terms.
